References: The words 'we', 'our' and 'us' used throughout this website refer to Port Arthur Escapes, its owners and agents.
Conditions of Sale: Accommodation at Wallaby Lodge can only be purchased through the Port Arthur Escapes website. ABN: 58 738 423 377 By using Port Arthur Escapes website you accept and are wholly bound by these Terms and conditions. The minimum age to use Port Arthur Escapes website is 18 years. No responsibility will be accepted by Port Arthur Escapes for bookings made by persons younger than 18 years of age. Exchange Rates: The purchasing of accommodation from Port Arthur Escapes is at the prices displayed on the availability calendar. The prices are in Australian Dollars and therefore subject to the international monetary exchange rate prevailing at the moment of purchase. Purchasers agree to purchase accommodation at the prevailing international exchange rate at time of purchase. Port Arthur Escapes will not be held in any way liable or responsible for fluctuations in international monetary exchange rates as these affect the purchase of accommodation via the Port Arthur Escapes website.
Purchase of Accommodation: The purchase of accommodation using the Port Arthur Escapes website is made using your credit card only - either Mastercard or Visa. The purchase fee for using these cards is 1.610% per transaction. You must be the owner or holder of the credit card used to purchase accommodation. Every action you make using the Port Arthur Escapes website is termed an 'electronic instruction.' Every electronic instruction you make is binding and will be acted upon without further confirmation or verification by Port Arthur Escapes. Once a purchase of accommodation has been made, a Booking Identification Number and a Confirmation of Reservation E-mail will automatically be generated and sent to the E-mail address nominated by you in your booking process. This should arrive within 15 minutes of your purchase. On rare occasions, for many reasons totally beyond our control, these confirmations may not reach you. It is your responsibility to E-mail us within 24 hours if you do not receive your Booking Identification Number and/or your Confirmation of Reservation E-mails. If you e-mail us to say that you haven't received them, we will be happy to resend them to you. Please take special note that some Internet Service Providers will place any e-mails from unfamiliar sources into your junk mail folder, so please take care to check your junk mail folder in case your service provider has placed our correspondence in there.
Access Code: The main entry door of Wallaby Lodge is governed by an electronic key pad. You will be sent your own four-digit Access Code with your Confirmation of Reservation E-mail following your purchase. It is the responsibility of you and each member of your travelling party to keep this Access Code safe and not divulge this Access Code to any unauthorised person. Port Arthur Escapes will not be held liable in any way for any losses incurred by you or any member of your travelling party through the divulging of this Code to any unauthorised person. You must also take care not to lose or forget this Code so that you may regain entry to the Lodge if you leave temporarily during your stay, e.g. to go sightseeing.
Cancellations: Any cancellations to your reservation must be made on-line via the Port Arthur Escapes website. To make a cancellation you must Log On using the E-mail address you nominated during your booking process and using your original Access Code. Cancellations made more than four weeks prior to the booking dates will incur a $50 cancellation fee, with the balance refunded to you. If you make a cancellation less than two weeks from your booking date, you will forfeit 50% of the purchase price of your booking, even if the reasons for your cancellation are beyond your control. The remaining 50% of the purchase price of your booking will then be refunded to you.
Change of Reservation Dates: In order to make a change to your reservation dates you will first need to cancel your original reservation, using the same process outlined above. A $50 cancellation fee will apply. The dates you then book will be purchased at the going rate displayed for those dates on the availability calendar.
No Shows: If for any reason either within or beyond your control you failed to arrive and utilise the dates you purchased, Port Arthur Escapes is under no obligation to refund any monies to you. In exceptional circumstances we may, solely at our discretion, refund part of your purchase price after the submission of substantive evidence from you via e-mail through the Port Arthur Escapes website.
Third Party Bookings: The term 'Third Party' refers to any person authorised to manage reservation information, including: travel agents; booking agencies; lodge caretakers; visitor information centres. Such authorised persons must abide by the Terms and Conditions of this website. If a booking is made for you via a third party, you understand that this booking is binding on you, in every respect, as though you had made the booking yourself. Authorised persons must not divulge any customer or reservation information, including Access Codes, to unauthorised persons, organisations or companies. Third parties will be held liable for any loss sustained as a result of releasing any such information to unauthorised persons.
Property Damage, Loss and Theft: Prior to your stay, and again, following your departure, the Lodge caretakers will keep a record of all items contained in the property and the condition of the property. If it is found that any loss, damage or theft has occurred during your stay, caused by you or any member of your travelling party, you will be billed for such via your credit card, or other means, regardless of how the loss, theft or damage occurred. You agree to be held fully liable for any loss, damage to property or theft caused by you or any member of your travelling party, including all associated costs of repair and/or replacement. You agree to pay for such loss, theft or damage with your credit card, the details of which will be retained for this purpose following any discovery of loss, theft or property damage. If the loss, theft or damage is such that we need to make a claim on our insurance, you will be liable to pay for the insurance excess payment. If your payment for loss, theft or damage is not made within four weeks of demand, you will be charged an interest rate on the amount outstanding at a rate of 18% per annum.
Privacy and Security of Information: Port Arthur Escapes website employs a secure server and payment system in order to safeguard the information you submit when making a reservation. Port Arthur Escapes respects your privacy and will not release your personal information to any unauthorised person, organisation or company under any circumstances without your express consent.
Safety: Wallaby Lodge is part of a 50 acre rural property which contains natural hazards such as unfenced open dams or water holes for watering stock. These constitute a potential hazard should a child fall into a waterhole or dam. It is essential that parents supervise their children at all times and keep children within the boundaries of Lookout Lodge and its immediate perimeter fence. If you take members of your travelling party up to visit Palmer's Lookout, please ensure you take the road route rather than cutting across the paddocks for safety. You agree that Port Arthur Escapes will not be held liable in any way for any injuries sustained by you or any members of your travelling party whilst staying at Lookout Lodge, however those injuries occur.
Security of Wallaby Lodge: If you leave Wallaby Lodge temporarily during your stay, for example to visit local attractions, you must ensure that all doors and windows are locked before you leave. The same must be attended to when you check out following your stay. You will be held liable for any loss or damage incurred as a result of failing to properly secure Wallaby Lodge.
